{"id":38,"date":"2026-03-26T13:24:16","date_gmt":"2026-03-26T13:24:16","guid":{"rendered":"https:\/\/floresenelmar.com\/?p=38"},"modified":"2026-03-26T19:59:47","modified_gmt":"2026-03-26T19:59:47","slug":"entre-convenios-y-realidades-en-busca-de-la-perspectiva-de-genero-en-la-proteccion-del-trabajo-maritimo","status":"publish","type":"post","link":"https:\/\/floresenelmar.com\/en\/entre-convenios-y-realidades-en-busca-de-la-perspectiva-de-genero-en-la-proteccion-del-trabajo-maritimo\/","title":{"rendered":"Between Conventions and Realities: In Search of a Gender Perspective in Maritime Labor Protection"},"content":{"rendered":"<div data-elementor-type=\"wp-post\" data-elementor-id=\"38\" class=\"elementor elementor-38\" data-elementor-post-type=\"post\">\n\t\t\t\t<div class=\"elementor-element elementor-element-af2c7a3 e-flex e-con-boxed e-con e-parent\" data-id=\"af2c7a3\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-d1b6994 elementor-widget elementor-widget-text-editor\" data-id=\"d1b6994\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>One of the main research lines of *Flores en el mar* focuses on reviewing the regulatory frameworks that govern maritime labor and cruise ship activity in Uruguay and at the international level.<\/p><p>The guiding question of this analysis is: **what do regulations say\u2014and what do they not say\u2014about women working at sea?**<\/p><p>Examining these frameworks also allows us to identify:<\/p><p>* Which rights are formally recognized<br \/>* What gaps exist<br \/>* At what scales responsibilities operate (national, international, corporate)<br \/>* And how these frameworks impact the everyday lives of those working on board<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2c3483d elementor-widget elementor-widget-heading\" data-id=\"2c3483d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Uruguay: Expanding Activity, Fragmented Regulation<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-abab66f elementor-widget elementor-widget-text-editor\" data-id=\"abab66f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>One of the first findings of the analysis of the Uruguayan legal system is that there is no specific regulation governing cruise ship activity.<\/p><p>Instead, general regulations apply, such as provisions of the Commercial Code related to maritime passenger transport, consumer protection law, and various international conventions of the International Maritime Organization (such as SOLAS or MARPOL).<\/p><p>Additionally, since most cruise ships arriving in Uruguay do not sail under the Uruguayan flag, the labor relationships of their crew members are regulated by other jurisdictions.<\/p><p>In transnational contexts, the key question is not only which regulations exist, but how they are implemented and how responsibilities are distributed among states and companies.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-71ade5e elementor-widget elementor-widget-heading\" data-id=\"71ade5e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Safety at Sea: The SOLAS Convention<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8b78f9e elementor-widget elementor-widget-text-editor\" data-id=\"8b78f9e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The International Convention for the Safety of Life at Sea (SOLAS), adopted by the International Maritime Organization in 1974, is one of the main international agreements in maritime safety.<\/p><p>It establishes mandatory technical standards for:<\/p><p>* Adequate equipment (lifeboats, life jackets, fire protection systems)<br \/>* Regular safety drills<br \/>* Mandatory crew training<br \/>* Fire prevention and evacuation procedures<\/p><p>Its primary goal is to protect human life in emergency situations.<\/p><p>However, SOLAS does not regulate labor rights nor does it address conditions related to gender inequality, harassment, or sexual and reproductive health. This does not mean that women are not protected under SOLAS; rather, it reflects the absence of an explicit gender perspective in its design.<\/p><p>The convention assigns primary responsibility to the flag state, while port states may conduct inspections in cases of non-compliance. In practice, when crews are multinational and companies operate across multiple jurisdictions, this structure can create grey areas regarding accountability.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ed478c6 elementor-widget elementor-widget-heading\" data-id=\"ed478c6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Labor Rights at Sea: The MLC 2006<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d97077e elementor-widget elementor-widget-text-editor\" data-id=\"d97077e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The Maritime Labour Convention (MLC 2006) of the International Labour Organization was conceived as a \u201cbill of rights\u201d for people working at sea.<\/p><p>It consolidates and modernizes labor standards related to:<\/p><p>* Employment conditions<br \/>* Health and safety<br \/>* Accommodation<br \/>* Food<br \/>* Rest<br \/>* Inspection and complaint mechanisms<\/p><p>It is one of the most important international instruments regulating maritime labor.<\/p><p>However, when analyzed from a gender perspective, significant gaps emerge.
